Plea agreement reached in Paul Braun matter

(Penticton, BC – September 12, 2018) – The City of Penticton was scheduled to commence trial against Paul Braun on September 12, 2018.  This matter was a prosecution of Paul Braun for contravening the City of Penticton’s Good Neighbor Bylaw for causing an obstruction while panhandling. 

Shortly before the trial was scheduled to commence, the City of Penticton and Mr. Braun came to a plea agreement under which Mr. Braun pleaded guilty to all counts, and agreed to make a joint sentencing submission with the City of Penticton before the court. 

The details of Mr. Braun's sentence include:

  • guilty pleas on all counts, with fines of $11.00 for each of the eight counts, for a total of $88.00; 
  • an order to pay the City of Penticton $57.00 as costs of the prosecution;
  • an order to comply with section 5.2 of Penticton’s Good Neighbor Bylaw, which prohibits panhandling to cause an obstruction;
  • an order specifically prohibiting Mr. Braun from attending within ten metres of the 200 Block of Main Street for one year; and 
  • by December 15, 2018, Mr. Braun must perform two hours of community service per weekday, for a total of 60 hours, by collecting litter along Main Street, or other works as agreed, while supervised by a member of Penticton City staff. 

"From the outset, the intention of this prosecution was to ensure that Mr. Braun obeys the same bylaws that everyone else in Penticton must obey.  The joint sentence meets this objective”, said Prosecutor for the City of Penticton, Jarrett Plonka.  “The City will continue to focus on addressing inappropriate behavior in the downtown through its progressive enforcement of City bylaws.”
