WorkSafeBC requires that a Hazardous Materials Survey be completed for any buildings that are undergoing demolition, renovation or additions that were built prior to 1990.   Please see our Hazardous Materials page for more information.

Site Disclosure Statements - Effective February 1, 2021

Site Disclosure Statement (Ministry of Environment)
Rezoning, Development Permits, Subdivision, and Building Permits (where soil disturbance is likely to occur) are triggers for a Site Disclosure Statement.  Properties with current, or a history of, specified industrial and commercial uses are required to submit the Site Disclosure Statement.  

Site Disclosure Waiver
The City of Penticton requires applicants who are not submitting a Site Disclosure Statement under the Environmental Management Act to submit a Site Disclosure Waiver.

Alternative solutions, formerly known as “equivalencies,” allow for flexibility in building construction. They provide your design team with a means to employ design methods that are different from the prescriptive Building Bylaw requirements.

Alternative solutions can apply to new construction or existing buildings.

Alternative solution submissions must demonstrate that the proposed approach provides an equal or better level of performance to the prescribed provisions in the Building Bylaw.

Alternative Solutions Request Form

This process is used to formalise a procedure to an applicant (owner, builder, agent, etc.) when a Code related plan review or inspection results are in dispute.

When is an Agency Agreement required?

At times, an owner may require another party to take direct control of a Building Permit and subsequent building inspections.  The Building Department's agency agreement, when signed by the owner to appoint someone to act on their behalf.

At the time of issuance of a building permit the owner or the owner's agent is to acknowledge those responsibilities listed on the permit condition letter by signing for the permit.  Therefore, only the owner or the owner's agent can pick up the permit.
